Honeybee Privacy Policy

Overview

Honeybee Health, Inc. ("Honeybee Health," or "we" or "us" or "our") recognizes that it is our duty to protect the privacy of the Personal Information you provide to us with respect to your access and use of our website (www.honeybeehealth.com) and related services (the "Website").

Therefore, we have adopted this privacy policy (the "Privacy Policy"), which sets forth, among other things, the type of information that will be collected, the purpose and use of the collected information, and your rights with regard to the collected information. This Privacy Policy governs how we collect and use your personal information wherever you use our Website. By accessing the Website, you are consenting to the collection and the use of your information by us, but only to the extent described herein. Should you wish to revoke your consent, you may do so by contacting us, information on which is set out in the Privacy Policy below.

Honeybee Health may make modifications, deletions and/or additions to this Privacy Policy ("Changes") at any time. Changes will be effective: (i) thirty (30) days after Honeybee Health provides notice of the Changes, whether such notice is provided through the Website user interface, is sent to the email address associated with your account or otherwise; or (ii) when you opt-in or otherwise expressly agree to the Changes or a version of this Privacy Policy incorporating the Changes, whichever comes first.

Information Privacy & Collection

Protection of Your Information

We are accountable for the information in our custody. Therefore, when we collect or use your information, we will utilize commercially reasonable safeguards to ensure all customer data is protected and encrypted from end to end. It should be noted that no security procedure is currently 100% effective. Should any breach of your Personal Information occur, we will inform you as soon as reasonably possible, as required by applicable law.

Type and Purpose of Collection

We collect information at various points in the Website to facilitate its use by our users. Specifically, two types of information are collected:

1. Additionally, Personal Information may be used and disclosed to the extent Honeybee Health may deem reasonably necessary to enforce the terms of any agreement between you and Honeybee Health, or to protect the rights, property or safety of any person or entity.

How we may receive, use and disclose your Personal Information

The following categories describe the typical ways that we may use and disclose your Personal Information without your written authorization:

For Treatment. Personal Information obtained from third parties by Honeybee Health will be used in order to dispense your prescription medications and provide the treatment and services you receive. We may disclose Personal Information about you to doctors, nurses, or other health care providers who are involved in taking care of you. We may also seek Personal Information about you from other health care providers and health information networks. For example, in order to fill your prescription, we may request your medical records from your doctor or disclose Personal Information to your doctor.

For Payment. We may use or disclose your Personal Information in order to bill and collect payment for products or services we provided to you.

For Health Care Operations. We may use and disclose your Personal Information for our day-to-day health care operations. For example, we may use your Personal Information to monitor the performance of the staff and pharmacists providing treatment and services to our customers or to improve the quality and the effectiveness of the health care services we provide.

Receiving Personal Information from Third Parties. We may receive your Personal Information from Third Parties who have marketed to you and have obtained your explicit consent to disclose your Personal information to Honeybee Health in order for Honeybee Health to service you. We will not collect any personal information from Third Parties who have not received your consent to disclose.

We may also use and disclose your Personal Information without your written authorization as follows:

Business Associates. We may contract with third parties to perform certain services for us, such as accounting services, consulting services, or information technology services. In some cases, these third party service providers, called Business Associates, may need to access your Personal Information to perform services for us. They are required by law and contract to protect your Personal Information.

Disclosures to Parents or Legal Guardians. We may release a minor's Personal Information to their parents or legal guardians consistent with applicable laws. For example, parents may order prescriptions on behalf of a minor child and access the child's prescription history.

As Required By Law. We will disclose your Personal Information when required to do so by applicable law.

To Avert a Serious Threat to Health or Safety. We may use and disclose your Personal Information to prevent a serious threat to your health and safety or the health and safety of the public or another person.

Organ and Tissue Donation. Consistent with applicable law, we may disclose your Personal Information to organizations engaged in the procurement, banking, or transplantation of organs for the purpose of tissue donation and transplant.

Military and Veterans. If you are a member or veteran of the armed forces, we may disclose Personal Information about you as required by military authorities.

Research. We may use your Personal Information to conduct research or disclose it to researchers as authorized by applicable law. For example, we may use or disclose your Personal Information as part of a research study when the research has been approved by an authorized review body that establishes processes to ensure the privacy of your information.

Workers' Compensation. We may disclose Personal Information about you for workers' compensation or similar programs that provide benefits for work-related injuries or illness.

Public Health Activities. Applicable laws may require or permit Honeybee Health to disclose certain Personal Information Information, for reasons such as: Preventing disease or telling people when they may have been exposed to or may be at risk of contracting a disease; Reporting reactions to medications, problems with products, or product recalls; Reporting information to your employer if we provide health care services to you at the request of your employer; Providing proof of immunization to your school if you are a student or prospective student of the school; and Notifying a government authority if we reasonably believe you are a victim of abuse or neglect. We will only disclose this type of information to the extent required by law, if you agree to the disclosure, or if we believe it is necessary to prevent serious harm to you or someone else.

Health Oversight Activities. We may disclose Personal Information to a health oversight agency for activities authorized by law. These oversight activities may include audits, investigations, inspections, and licensure. These activities help the government monitor the health care system, government programs, and compliance with civil rights laws.

Judicial and Administrative Proceedings. We may disclose your Personal Information pursuant to a court or administrative order, subpoena, discovery demand, or other lawful process. If permitted to do so, we will attempt to provide you notice prior to disclosing your PHI unless such notice has been provided by another party to the dispute.

Law Enforcement. We may disclose your Personal Information to law enforcement as required by law or pursuant to a court order, subpoena, warrant, or similar process. We will attempt to provide you with notice prior to disclosing your PHI to law enforcement if we are permitted to do so.

Coroners, Medical Examiners and Funeral Directors. We may disclose Personal Information to a coroner or medical examiner. This may be necessary to identify a deceased person or determine the cause of death. We may also disclose Personal Information to funeral directors as necessary to carry out their duties.

Correctional Institution. If you are or become an inmate of a correctional institution, we may disclose to the institution or its agents Personal Information necessary for your health and the health and safety of others.

Specialized Government Functions. We may disclose your Personal Information to units of the government with special functions, such as the U.S. Secret Service for the protection of the President, or the U.S. Department of State to make medical suitability determinations about individuals who are members of the foreign service.

Other uses of Personal Information

Other uses and disclosures of Personal Information not covered by this Notice or the laws that apply to us will be made only with your written permission. If you provide us permission to use or disclose Personal Information about you, you may revoke that permission, in writing, at any time. If you revoke your permission, we will no longer use or disclose Personal Information about you for the reasons covered by your written authorization. You understand that we are unable to take back any disclosures we have already made with your permission, and that we are required to retain our records of the care that we provided to you.

Use Of Unencrypted Email

As part of our services, we may utilize unencrypted email. Since the email is not encrypted and is transmitted over the internet, a third party may be able to access the information and read it. Additionally, once the email is received by you, the security of that email depends on your email provider and your adherence to good privacy practices. Accordingly, someone may be able to access your email account and read it. By agreeing to these terms of service, you acknowledge that you understand that there are risks related to providing information electronically, which is not encrypted and that the privacy of such communications cannot be guaranteed by Honeybee Health. Understanding the risks, you hereby consent to the use of unencrypted email by Honeybee Health to communicate with you.

Your rights regarding Personal Information about you

Although your health record is the property of Honeybee Health, the information belongs to you. You have the following rights regarding your Personal Information:

Right to inspect and copy

You have the right to examine any of your Personal Information that we collect. We reserve the right to charge you a reasonable administrative fee to access your information, as permitted by applicable law. In certain cases, we may not be able to provide you with access to all of your Personal Information (example: if the information also pertains to the Personal Information of another user).

Right to Amend

If you feel that Personal Information in your record is incorrect or incomplete, you may ask us to amend the information. You have this right for as long as the information is kept by or for Honeybee Health. Was not created by us, unless the person or entity that created the information is no longer available to make the amendment; Is not part of the Personal Information kept by or for Honeybee Health; or Is accurate and complete.

Right to an Accounting of Disclosures

You have the right to request an “accounting of disclosures”. This is a list of certain disclosures we made of your Personal Information, other than those made for purposes such as treatment, payment, or health care operations. Your request must state a time period, which may not be longer than six years from the date the request is submitted and may not include dates before January 1st, 2013. Your request should indicate in what form you want the list (for example, on paper or electronically). The first list you request within a twelve month period will be free. For additional lists, we may charge you for the costs of providing the list. We will notify you of the cost involved and you may choose to withdraw or modify your request at that time before any costs are incurred.

Right to Request Restrictions

You have the right to request a restriction or limitation on the Personal Information we use or disclose about you. For example, you may request that we limit the Personal Information we disclose to someone who is involved in your care or the payment for your care. You could ask that we not use or disclose information about a prescription you had to a family member or friend. We are not required to agree to your request. If we do agree, we will comply with your request unless the information is needed to provide you emergency treatment. For example, you may ask that we only contact you via mail to a post office box. Right to Opt-Out of Sales & Marketing communications

You can opt-out of receiving sales and marketing communications from us. Right to Opt-In for Sensitive Data Processing

Personal Information, such as health data, financial information, and other sensitive categories, require your explicit consent for processing. We will only collect and process this sensitive information when you choose to opt-in, providing your clear and affirmative consent. You may withdraw this consent at any time, and we will cease processing your sensitive data, unless required by law or necessary to fulfill contractual obligations, such as dispensing your prescriptions.

Right Against Automated Decision-Making 

We do not engage in automated decision-making processes that could significantly affect you. All decisions regarding your Personal Information, including health-related data and account settings, are reviewed by authorized personnel to ensure fairness and transparency. Should any decision-making process involve automation, you will have the right to request human intervention, express your point of view, and contest any decisions made based on automated systems.

Right to a Paper Copy of This Notice 

You have the right to a paper copy of this Notice of Privacy Practices even if you have agreed to receive the Notice electronically. You may ask us to give you a copy of this Notice at any time.

Withdrawal of Consent

You may withdraw your consent to the collection of Personal Information at any time by sending an email to us. Upon receiving notice that you have revoked your consent, we will stop using your Personal Information within a reasonable time, which will vary depending on what information we have collected and for what purpose. Please note that we will send you an email confirmation upon receipt of your request. Therefore, if you do not receive a confirmation email, please contact us again with your request. If you do choose to withdraw such consent, your access to the Website may be diminished, or your ability to choose some of the options on the Website may be limited.

Request to Delete

Honeybee Health’s privacy policy respects and accommodates for any patient who requests to have their information deleted from our system, in accordance with all state and federal laws that govern the practice of pharmacy. Right to File a Complaint

Returns and Replacement Orders

We will not sell, rent or disclose to outside parties the information we collect and save except that we may share the collected information with other parties as follows:

1. Affiliated Service Providers: We have agreements with various affiliated service providers to facilitate the functioning of the Website, with whom we may share the information we have collected. For example, we may share your credit card information with the credit card service provider to process your purchase. All administrative service providers that we use are required to have the same level of privacy protection as we have, and therefore we expect that your information will be handled with the same level of care that we employ. Additionally, for example, we may use analytic services.

2. Where required by law: We may share the collected information where required by law, specifically in response to a demand from government authorities where such demand meets the legal requirements.

3. Statistical Analysis: We may share Non-Personal Information and aggregated information with third parties, including but not limited to for advertising or marketing purposes. No Personal Information will be shared in this manner.

4. Transactions: In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition, or in any other situation where Personal Information may be disclosed or transferred as one of our business assets.

Location-Based Services Consent

You hereby expressly consent to our use of location-based services and expressly waive and release Honeybee Health from any and all liability, claims, causes of action or damages arising from your use of Honeybee Health’s services, including but not limited to use of the Website, or in any way relating to the use of the precise location and other location-based service

International Visitors

The Website is hosted in the United States and is intended for visitors located within the United States. If you choose to use the Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Website. By providing any information, including personal information, on or to the Service, you consent to such transfer, storage, and processing.

Payment Processing

Payment details you provide will be encrypted using secure sockets layer (SSL) technology before they are submitted over the internet. Payments made on the Website are made through our payment gateway provider. You will be providing credit or debit card information directly to our payment gateway provider which operates a secure server to process payment details, encrypting your credit/debit card information and authorizing payment. Information which you supply to our payment gateway provider is not within our control and is subject to their own privacy policy and terms and conditions.

Terms of Service

Children’s Privacy

Protecting the privacy of young children is especially important. Our Website is not directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13 without obtaining parental consent. If you are under 13 years of age, then please do not use or access the Website at any time or in any manner.
